Plug Power, the Latham, New York, fuel cell manufacturer, was named in a lawsuit against six companies following the May death of a Procter & Gamble employee who was riding a forklift powered by a Plug Power fuel cell.

The lawsuit was filed by eight individuals in the 9th Judicial District Court, Rapides Parish, Louisiana, according to a document filed by Plug Power with the U.S. Securities and Exchange Commission.

According to reports, William Allen Kendrick, 56, was operating a forklift at a Procter & Gamble plant in Pineville, Louisiana.  At around 3:00 a.m. May 24, the forklift exploded and caught fire. The accident killed Kendrick. No one else was directly injured in the accident, a report said, though six people sought treatment for ringing ears or physical distress.

The lawsuit alleges claims against Plug Power and the five corporate co-defendants for defect in construction and composition, design defect, inadequate warning, breach of express warranty and negligence. It claims an unspecified amount of damages for wrongful death and personal injuries, among other damages.

Plug Power said in the 8-K filed on Thursday that it "intends to vigorously defend the litigation."

In that statement, Plug Power said it does not know what the outcome of the lawsuit will be. "However, the company does not expect the lawsuit to have a material impact on the company’s financial position, liquidity or results of operations, or to otherwise have a material adverse effect on the company," the statement says.

Plug Power (Nasdaq: PLUG) makes fuel cells used to power forklifts in warehouses and distribution centers. Fuel cells are seen as an alternative to lead-acid batteries. Plug has shipped more than 20,000 fuel cell units to dozens of customers including Amazon.com Inc. (Nasdaq: AMZN), Walmart Inc. (NYSE: WMT) and Nike (NYSE: NKE).


Plug is one of the largest manufacturers in the area and is also one of the area's few public companies, employing more than 600 engineers, researchers and technologists.

Following the accident, Plug Power CEO Andy Marsh said in a statement on May 29 that the company was participating in an investigation led by Procter & Gamble to find what caused the accident.

"The Pineville plant utilizes equipment from multiple vendors. The Plug Power fuel cell unit is just one part of that larger system," Marsh said at the time. "We and other suppliers involved in the Procter and Gamble material handling system are actively contributing to the root cause investigation of this accident."

In a statement to the Albany Business Review Plug Power said: "The 8K is self-explanatory and is in line with our commitment to keep shareholders informed. Please note that the 8K states that we expect no material impact to our business."

Plug Power's stock was selling at $1.96 on Friday morning. The price is around what Plug has been selling at all year.

A former Philadelphia police officer has been charged with first-degree murder following a shooting last year.

In June of 2017, Ryan Pownall was involved in the deadly shooting of 32-year-old David Jones in Hunting Park.

It happened after Jones was stopped for riding a dirt bike on city streets and, police say, he reached for a weapon.

District Attorney Larry Krasner said during a news conference on Tuesday that Pownall attempted to shoot Jones but his gun jammed.

He says Jones tossed his own gun to the ground and began to run away.

"Video recovered from the scene shows Jones was unarmed, and he never turned toward Pownall or gestured in a threatening manner during his flight," Krasner said.

Pownall fired at least three shots toward Jones and nearby traffic, Krasner said, hitting Jones twice in the back, killing him.


Krasner says Jones' gun was recovered by investigators about 25 feet in the opposite direction from where he was shot.

In announcing his dismissal last September, Commissioner Richard Ross said other errors committed by Pownall included stopping Jones with witnesses present in his patrol car and failing to notify police dispatch that he was stopping Jones in the first place.

Black Lives Matter activists held up a mock wanted poster of Pownall as they hailed Krasner's announcement.

But the Fraternal Order of Police and Pownall's family members slammed Krasner and decried the charges.

"We believe first-degree murder is absolutely absurd in this case," said FOP Lodge #5 President John McNesby. "We're going to stand with his wife, Tina, his children, as well as every officer out there today, and in the 15th District, and citywide, to make sure they get what's needed and to that he's eventually brought home in the coming days."

Pownall's brother, Edward, said his family is "horribly saddened and disturbed."

"He loves being an officer. He's a great person," Edward Pownall said.

Pownall has turned himself into police. If convicted, Pownall could face the death sentence or life in prison without parole.

Ryan Pownall, who as a Philadelphia Police officer last year fatally shot a man who ran from a traffic stop, turned himself in Tuesday to be charged with murder and related counts — the first time in nearly two decades that a city police officer will be criminally prosecuted for an on-duty shooting.

District Attorney Larry Krasner said at a news conference Tuesday morning that a grand jury determined Pownall unnecessarily fired his weapon at 30-year-old David Jones, who had been riding a dirt bike in North Philadelphia and allegedly carrying a gun that he dropped as he fled from Pownall.

Krasner said the charges are an example of "applying justice even-handedly," but added that it was "regrettably unusual" how infrequently officers in Philadelphia had previously faced criminal consequences for using their service weapons.

"This is a city, like many other American cities, where there has not been accountability for activity by police officers in uniform, especially when that activity involves violence against civilians," said Krasner, who was sworn into office earlier this year and quickly reiterated a campaign promise to pursue cases against police officers who shoot, if evidence supported it.

The decision was all but certain to spark criticism from the police union, which scheduled a news conference for Tuesday afternoon to discuss the case.

It also drew immediate praise from activists who last year staged near-daily protests and disruptions, as well as other Krasner supporters.

Isaac Gardner and Christopher Norris, two of the most visible protesters in the aftermath of the shooting, hailed the decision outside the District Attorney's Office as soon as Krasner's news conference ended. Gardner said that Krasner was "stepping up and doing the right thing" and that he and fellow activists planned to see the case through until resolution.

The Philadelphia Coalition for a Just District Attorney, a local group of criminal justice activists, issued a statement saying in part: "In keeping to his commitment to investigate police killings, Mr. Krasner is telling thousands of Philadelphians that police should not have a protected status and must be held accountable for the violence they enact in our communities."

Pownall, 36, was dismissed from the Police Department last year over the shooting, with Commissioner Richard Ross citing a host of departmental violations and saying Pownall displayed "poor judgment" during the altercation with Jones.

According to a grand jury report detailing Pownall's arrest, Pownall cursed at Jones after stopping him for riding the dirt bike. When he frisked Jones, the report says, he said he felt a gun, and a struggle ensued. Jones broke free and ran away, according to the report, and Pownall tried to fire his service gun but it jammed. He fixed his gun and fired at least three shots, the report says, striking Jones in the back.

Jones' weapon — which he could not have owned legally due to previous felony convictions — was later found on the ground "roughly 25 feet from where Pownall was firing, in the opposite direction of Jones' flight," the report says.

"[Jones'] death was not necessary to secure his apprehension – an apprehension that would never have been necessary if Pownall had not incited the confrontation," the report says.

The shooting generated a wave of protests and disruptions, including at city news conferences and outside Pownall's home. Activists frequently called for his arrest, and cited the fact that the white officer had been involved in another on-duty shooting of a black man from behind in 2010.

In that case, Pownall was one of several officers who fired at Carnell Williams-Carney, who had run away from police in Frankford. Pownall later testified that he believed he fired the shot that struck and paralyzed Williams-Carney, although ballistics tests could not be conducted because the bullet remains lodged in his back.

Pownall was hired earlier this year by the Philadelphia Parking Authority as a maintenance worker, but he quickly resigned after colleagues raised concerns about it.

He was to face charges of murder, possession of an instrument of crime, and reckless endangerment. His arraignment had not yet been scheduled, Krasner said.

As part of an investigation we have been performing, we discovered that Ronald A. Lucas, a former Passaic County sheriff officer with the Civil Division lied about his on-the-job shoulder injury.  Lucas claimed that he fell on the job on June 28, 2011 at 687 Indian Road, Wayne, NJ and that he injured his left shoulder requiring several pins.  He then filed a disability claim with the New Jersey Division of Pensions and Benefits (Police and Firemen Retirement System).  He was granted disability for one year with subsequent review.  After he retired with claimed disability, he obtained a job as part-time security guard at the Pequannock High School.
Bombshell evidence contradicting Lying Lucas’ injury claims: We have obtained a report by Lt. Nick Mango who stated that nobody was injured at the scene.  The report by Lucas also states that he stumbled and not fell.
We discovered that Mr. Lucas suffered shoulder injuries while playing football and lifting heavy weights over his lifetime.  He was a linebacker with the Pompton Lakes Cardinals (he played at position #41), using his shoulder to hit and tackle his opponents during practice and during football games.  He also lifted very heavy weights to do body building.  Lucas has fallen on his shoulder probably thousand times during his athletic and training career.
Everybody knows that linebackers hit and tackle their opponents using their shoulders.  These athletes also lift heavy weights and they end-up injuries their shoulders.   He (Lucas) even made the All County Team in 1980, showing how hard he was working out.  Based on our investigation, we found that weight lifting athletes do suffer shoulder injuries of the type claimed by Lucas.
He also trained his two sons (Dean Lucas and Ronnie Lucas) into playing TE and DE positions also with the Cardinals football team.  In fact, linebackers suffer at least 13.5 percent of all football injuries and at least 65 percent of the linebackers end up undergoing surgery.
Lt. Nick Mango wrote in his June 28, 2011 report that “nobody was hurt”.  Also, Lucas never wrote in his June 28, 2018 report that he was injured.  He specifically wrote:  As I entered the woods I stumbled”.  He never wrote that he was injured.  However, during this grand jury testimony, he provided a diametrically different picture:
Lucas claimed that he fell on his elbow and shoulder, but was able to regain his balance, and he ran into a wooded area to seek cover behind a large boulder.   Lucas claimed that he tore his biceps and had surgery on his shoulder, and “ended up having a pretty severe injury” in his shoulder, requiring “five pins.”  Of course we now know that this guy was a football player and body builder and suffered these injuries over his many years of lifting heavy weights and hitting his opponents with his shoulder (he was a linebacker with the Pompton Lakes Cardinals at #41).  This guy then defrauded the Police and Firemen Retirement Fund by claiming disability and started the double dipping.
So, from flip-flopping regarding the color of the gun; to whether the door was closed or open; to whether he knocked the door or not; to whether he suffered a major injury or not, Lying Lucas has some serious credibility issues; and all his lies were allowed to poison the grand jury deliberations.
We have obtained photos showing Mr. Lucas lifting weights, after his alleged job-ending disability.  See for example the attached image that is dated December 2013.
It is obvious to a reasonable and objective person that Lucas (in his mid-50s) took this incident on June 28, 2011 to claim on-the job-injury to be able to repair his previously injured shoulder at taxpayers’ expense and to retire and then blame Basilis Stephanatos for his injuries.  After he retired, he started the double dipping.  The finest of New Jersey at "work".

MIDDLETOWN, CT — 


There were no injuries from an early-morning fire in a wall at Kleen Energy Tuesday that saw crews fighting the blaze in challenging conditions amid high heat and humidity.

South Fire District firefighters were called to the 1349 River Road plant at approximately 5:30 a.m. on the report of smoke coming from a fire in the wall near an exhaust turbine, according to Chief Michael Howley.

The blaze, in the area of the exhaust where it feeds into the heat recovery unit, took several hours to knock down, he said.

Immediately, officials called in extra mutual aid from nearby towns because of weather conditions, so the chief could rotate crews to prevent heat exhaustion and other dangers.

“It was a long, labor-intensive operation,” said Howley, who added the blaze didn’t affect natural gas lines or cause other safety concerns.


“It was a difficult fire to get at, because it was in between steel siding on the interior and exterior. It just took manpower and a lot of equipment to get that all opened up and get that under control.”

By 8:30 a.m., the scene was under control and the majority of fire stations (Middletown, Haddam, Cromwell, Middlefield and Westfield companies) were returned to their posts, the chief said.

In November, a diesel leak in a turbine there touched off a minor fire in a generator.

The generator had experienced a small diesel fuel leak earlier in the day during an annual fuel changeover in the engine.

Kleen Energy was the site of a deadly natural gas explosion Feb. 7, 2010, while the facility was still under construction. The blast killed six people and injured as many as 60 others.

The fire marshal is investigating the cause of Monday’s blaze with the help of state fire officials.

A tranquil Labor Day weekend on Bass Lake ended with horrific news. Mike Martinez was in line getting ready to return his jet ski when he noticed a boat speeding through the slow zone with two frantically screaming adults.

"They just ran her over, they just ran her over. We had the orange flag and they just ran her over. Someone please call 911, someone please help her," said Mike Martinez, describing what the frightened people onboard were yelling.

The Madera County Sheriff's Office is still investigating what happened, but they say a 7-year-old girl and a 32-year-old man were run over by a boat. Witnesses tell us the girl appeared to be tubing when she was injured around 3 o'clock.

"They worked on her for quite awhile. I was just watching from a distance and she didn't seem very responsive."


Martinez says boaters and vacationing EMTs jumped in to help. Others started praying.

The girl was eventually airlifted to a local hospital where she later died. The accident is a sobering reminder for even the most experienced boaters.

'You shudder to think this could really happen a whole lot more if people weren't careful."

Deputies say the circumstances of the crash are still under investigation.

The 32-year-old who was injured, is still recovering at a hospital.

Sioux Falls Fire Rescue says the construction crew was using a crane to install the trusses when the wind blew one over creating a domino effect. 


One construction worker was on top of the 18-foot trusses when they went down. 

Firefighter say his injuries were not life-threatening.

A construction worker was injured Thursday afternoon in Chula Vista when an excavator he was operating overturned on a steep hill, fire officials said.

The accident happened around 12:50 p.m. near Via Maggiore and Via San Vitale in a housing development under construction in the northeast corner of the city, Chula Vista Fire Department Battalion Chief Rich Brocchini said.

“He was operating the Bobcat toward the bottom of a hill, about 200 feet down, when it tipped over and slid down just a very short amount,” Brocchini told the Union-Tribune. “It was a very good thing he was wearing his seat belt.”

The injured worker was able to crawl out of the overturned construction vehicle, but his injuries made it so he couldn’t hike to the top of the hill, fire Capt. Brad Carlin told OnScene TV.

Medics took the victim to a trauma center, though it wasn’t immediately clear how serious his injuries were, Brocchini said.

“The rescue was a little bit difficult just due to the steepness of the slope here and the distance we had to travel,” Carlin told OnScene TV.

Four firefighters made their way down to the injured victim, loaded him in a rescue basket and attached the basket to a large wheel, which they used to help move him up the steep grade, Brocchini explained.

“It was pretty intense, it was a big operation, but the rescuers worked very fast,” Brocchini said.

The state Division of Occupational Safety and Health, or Cal/OSHA, was expected to investigate the incident.

ELLENSBURG, WA- Washington State Troopers said a blown tire is the cause of a fatal accident that killed two people.

62-year-old Michael Edelbrock of Snohomish, was driving westbound on I-90 when the tire blew and he lost control. The motorhome hit the guardrail and then went into Wilson Creek below.

61-year-old Lois Edelbrock died at the scene and 6-year-old Kaci Edelbrock later died at the hospital.

Three of the passengers were taken to Harborview Medical Center in Seattle, one was airlifted to Kittitas Valley HealthCare, two were taken to Virginia Mason Memorial Hospital, and one of the children was not injured.

ELLENSBURG, WA- 


Two people are dead following a rollover crash on I-90 Monday.

It happened around 3:30 p.m. near milepost 110, just outside of Ellensburg. Washington State Patrol Troopers said a 61-year-old woman died at the scene and a 6-year-old girl later died at the hospital.

The motorhome was heading westbound on I-90 when it lost control and went through a guard rail and into Wilson Creek.

Nine people were inside the motorhome, six children and three adults. One adult and two children have been airlifted to Seattle.

As of 6:00 p.m. Troopers had one lane open in both directions while they work to clear the crash.

ELLENSBURG, Wash. — 


Washington State Patrol troopers said a blown tire caused a motor home to crash into Wilson Creek, killing two people and injuring six Monday afternoon.


Michael Edelbrock, 62, of Snohomish was driving a 2007 Beaver motor home pulling a trailer west on Interstate 90 shortly before 3:25 p.m. when a tire blew about a mile south of Ellensburg, according to a State Patrol news release. The blown tire caused Edelbrock to lose control of the vehicle, which struck a guard rail, went into the median and down the embankment to the creek, the release said.

Lois Edelbrock, 61, a passenger in the motor home was pronounced dead at the scene while Kaci Edelbrock, 6, died at KVH Hospital in Ellensburg, the release said. They were both Snohomish residents, the release said.

Michael Edelbrock and two passengers — Jessica Edelbrock, 41, and Chase Edelbrock, 3, both of Monroe — were flown to Harborview Medical Center in Seattle, where their condition was not immediately available.

Two other passengers, Hank Edelbrock, 6, and Cody Edelbrock, 13, were taken to Virginia Mason Memorial Hospital in Yakima, where their condition was not available. Lane Edelbrock, 15, was taken to KVH Hospital, where he was treated and released.

Reese Edelbrock, 8, was not injured in the crash, the release said.

The accident is under investigation, and troopers said intoxicants were not a factor. Only two of the nine people in the crash were wearing seat belts, the release said.

The crash closed I-90 in both directions for a time Monday afternoon, and the state Department of Ecology was on the scene handling leaking fuel from the vehicle.

IVANHOE, TEXAS — 


An 18-year-old Devers man and his grandparents, as well as a 48-year-old man from Tyler were killed Monday afternoon in a wreck on U.S. Highway 69 in Tyler County.

The crash, which happened around 1:45 p.m. between Ivanhoe and Woodville, shut down the highway in both directions for more than four hours according to a news release from the Texas Department of Public Safety.

Troopers say a Ford F250 pickup driven by Travis Layne Jordan,18, of Devers, was traveling south bound when it crossed over into the north bound lanes and struck a Dodge pickup towing an RV and driven by Robert Alan Beard, 48, of Tyler.

Jordan and his grandparents, Harvey Lamar DuBose, 75, and Ann Jones DuBose, both of Hull who were riding with him were all killed in the wreck according to the release.
Robert Alan Beard, the driver of the Dodge, was also killed and a passenger in his truck, Leslie McCaa, 41, of Tyler, was transported to Christus St. Elizabeth Hospital in Beaumont with serious injuries according to the release.

The highway was reopened by a little after 7 p.m.

4 die in Highway 69 crash, south of Woodville

DPS have released the names of four people killed in an accident near Woodville, on Highway 69.

Beaumont media is reporting the crash, which happened around 1:45 p.m. between Ivanhoe and Woodville, shut down the highway in both directions for more than four hours, according to DPS.

Troopers say a Ford F250 pickup driven by Travis Layne Jordan,18, of Devers, was traveling south when it crossed over into the north lanes and hit a Dodge pickup towing an RV and driven by Robert Alan Beard, 48, of Tyler.

Jordan, and his grandparents, Harvey Lamar DuBose and his wife, Ann Jones DuBose, both of Hull, were killed in the wreck.

Beard was also killed. A passenger in his truck, Leslie McCaa, 41, of Tyler, was transported to a Beaumont hospital with serious injuries, according to the release.

The highway was reopened by a little after 7 p.m.

Troopers say they are still working to determine the factors that contributed to the crash.

Arizona man charged in fatal semi-truck crash

HUBBARD TOWNSHIP, OHIO — 


An Arizona man is facing several charges, including drunk driving, after he overturned his semi on Interstate 80 Monday evening, killing his passenger.

The Ohio State Highway Patrol said the crash occurred at 6:23 p.m. in the eastbound lane about 100 feet from the Pennsylvania border.

Ademayowa A. Saint, 46, of Glendale, Ariz., was driving a 2005 Freightliner when he went off the right side of the road, struck a ditch and several trees before jacknifing, a patrol report states. An unidentified female passenger in the sleeper berth — the portion of a semi between the driver’s cab and trailer — died in the crash. A report from the Trumbull County 911 Center states the woman was trapped inside for nearly two hours.

Saint was determined to be under the influence of alcohol and illegal drugs at the time of the crash, according to the patrol. Saint was expected to be taken to the Trumbull County Jail on charges of aggravated vehicular homicide, marijuana possession, open container and operating a commercial vehicle while under the influence. He had not been booked in as of 11:30 p.m. Monday. He was not injured.

The crash is still under investigation and the patrol is asking anyone who witnessed the crash to contact them at 330-898-2311. The patrol was assisted by the Eagle Joint Fire District, Hubbard Township Police and the Mercer County Sheriff’s Office.

The Ohio State Highway Patrol says it believes an Arizona man was driving drunk when his semi-tractor trailer crashed along Interstate 80 in Hubbard, killing a woman who troopers believe was his fiancee.

Troopers say Ademayowa A. Saint, 46, of Glendale, Arizona was driving toward Pennsylvania at around 6:30 p.m. Monday when his truck went off the road, struck a ditch, and several trees before jackknifing.

Authorities have not released the name of the woman who was in the sleeper berth of the truck, but believe she was Saint's fiancee. The woman died in the crash. Saint was not injured.

The Ohio State Highway Patrol Crash Reconstruction Unit investigated the accident.

According to troopers, Saint was under the influence of alcohol and illegal narcotics at the time of the crash.

Saint was booked into the Trumbull County Jail on charges of aggravated vehicular homicide, possession of marijuana, having an open container, and operating a commercial vehicle while under the influence.

He is expected to be appear for a video arraignment on the charges Tuesday.

Eastbound I-80 was down to one lane after the crash but has since re-opened.

Any witnesses to the crash are asked to contact the Ohio State Highway Patrol Warren Post at 330-898-2311.

A Wisconsin pilot, who was an assistant district attorney in Milwaukee, crashed a plane into a Michigan lake on Friday, Aug. 31 -- and lost his life.


Ronald Dague, presumed dead

Officials with the Milwaukee County District Attorney's Office identified him as Ronald Dague, 64. Mackinac County sheriff's officials said he was from East Troy.

Below is a statement from John Chisholm -- Milwaukee County district attorney:

"Tragically, we learned that our colleague Assistant District Attorney Ronald S. Dague lost his life in an airplane accident last Friday night. Ron was a valued member of our General Crimes Unit and served with distinction in many capacities in the District Attorney’s Office since 1992.

On behalf of the District Attorney’s Office and all our colleagues in the criminal justice system, I extend my deepest condolences to Ron’s family and friends at this difficult time. Ron was a gifted trial attorney, a devoted student of the law, and a passionate defender of equity, fairness, and justice. His advocacy helped build a safer community for everyone living in Milwaukee County.

At a personal level, Ron was a devoted husband and father who deeply loved his family and his absence will be keenly felt. Please keep his wife and young daughter in your prayers. Dague was Milwaukee County's most experienced drunk driving prosecutor.

"The most complicated area of law and science that I've handled in my 23-year career," said Dague.

In 2013, he talked with the FOX6 Investigators about the failure to enforce ignition interlock devices.

"We have yet to be able to successfully prosecute even one case in Milwaukee County. So none," said Dague.

According to the Mackinac County Sheriff's Office, shortly after 9:45 p.m., the plane crashed in Lake Huron -- that's in Michigan's Upper Peninsula.

We're told the plane took off from the Mackinac County Airport shortly before and was heading to Mackinac Island.

Residents reported seeing the plane flying low and then they heard the impact.

Dague was the only one on board at the time.

A search was conducted over the weekend, involving the sheriff's office, U.S. Coast Guard and Michigan State Police. A police dive team was using sonar equipment in the search.

Sheriff's officials said the engine and main cabin of the plane were located Sunday. The pilot wasn't inside. Officials said recovery efforts continue for the pilot's remains and other debris.



The FAA and NTSB are investigating.

Crews are working to locate a plane in Lake Huron.

Investigators say the plane went down moments after taking off from Mackinac County Airport in St. Ignace.

The Mackinac County Sheriff’s Office says a Wisconsin man was the only person on board when it crashed.

The airport manager tells us the plane took off around 9:50 p.m. Friday.

He says the man was on his way to Mackinac Island to pick up a group of people, then head back to Wisconsin.

Nearby residents say the plane was flying low and turned onto its side before they heard the impact.

The U.S. Coast Guard says the lack of moonlight can create problems for pilots.

“The moon had not come up yet, so it was really dark over the water,” said Jason Evans of the U.S. Coast Guard Air Station Traverse City. “Really black and really dark. It’s really tough to make out the horizon when you’re looking east.”

Numerous law enforcement agencies are helping with the search.

Michigan State Police is using sonar to help find the plane and pilot.

CORNWALL, NY — 


An employee of a tree-trimming company is dead after he was electrocuted by a live power line in Cornwall on Monday.

Cornwall-on-Hudson police say John B. Nuzzolo, 39, of Newburgh died at around 9 a.m as he was trimming a tree 40 feet in the air. Central Hudson, which owns the lines the victim died on, says he was a third-party tree contractor who worked for Simply Stump Grinding and Tree Removal.

Central Hudson says they cut power to the grid, which affected around 2,500 customers for roughly an hour. Around 20 additional homes on Maple Road didn't get their power back until noon.

"This incident truly underscores the importance of staying safe around electric lines whether they're on the ground or in the air," Central Hudson Spokesperson John Maserjian said.

A tree trimmer was electrocuted yesterday in Cornwall on Hudson, New York state, after he touched an overhead power line while working from a bucket truck.

John Nuzzolo, 39, was trimming trees in the town, which lies due north of New York City, when he clipped the line and took a massive electrical shock. The utility - Central Hudson Gas & Electric – was called in to shut off the power before anyone was able to rescue Nuzzolo from the bucket truck. He succumbed to his injuries while on site. No one else was hurt in the incident. An investigation has been launched.

A Newburgh man died of electrocution while trimming a tree Monday morning on Maple Road, police said.

John B. Nuzzolo, 39, was electrocuted when he came into contact with a live power line adjacent to the tree he was cutting about 9:17 a.m., according to a news release from Cornwall-on-Hudson police.

Nuzzolo was sub-contracted by Simply Stump Grinding and Tree Removal Co. out of Newburgh to help with removing a large tree at 29 Maple Road, police said.

Upon hearing reports of the electrocution, Central Hudson utilities de-energized the line by shutting off power to the area from 9:30 to 10 a.m., affecting 2,570 customers, CenHud spokesman John Maserjian said.

“We are devastated by this incident,” Maserjian said.

“It shows the importance of staying away from electrical lines, even while working in trees.”

Occupational Safety and Health Administration officials were notified of the incident, police said.

Nuzzolo’s remains were taken to the Orange County Medical Examiner’s Office for further investigation, according to the release.

Town of Cornwall police, Cornwall Volunteer Ambulance, and Storm King Fire Company also responded to the incident.

A man died and a boy was injured after a single-engine plane crashed at Whiteman Airport in Pacoima on Monday afternoon, officials said. 
The overwhelming majority of the crashes occur during takeoff or landing and are attributed mostly to pilot error.  Here, the news reports state that it was a possible plane issue.
 

The crash happened about 5:09 p.m. at the facility located at 12653 Osborne St., according to an alert from the Los Angeles Fire Department.

As the Cessna 150L was taking off from the airport, it experienced an unknown problem, and an emergency was declared over the radio, Fire Department Capt. Erik Scott said. The aircraft then struck a building and landed upside down, the statement read.

Firefighters were able to extricate both victims who were on board. They were later identified by officials as a 12-year-old boy and a 60-year-old man.

The man—a flight instructor—suffered cardiac arrest and was given CPR before he and the boy were taken to nearby trauma centers, officials said.

The man was in grave condition but later died, a Fire Department spokesperson said. The juvenile was last listed in critical condition, according to the alert.

Previously, the Fire Department identified the younger victim as being 13 years old. That may have been the case because a bulldozer crew said he was apparently celebrating his birthday on Monday.

The boy's father, who purchased the flying lesson as a birthday gift for his son, was at the airport and witnessed the crash, according to the crew.

The Cessna crashed about a half-mile from the departure end of the runway, said Ian Gregor, a spokesman for the Federal Aviation Administration.

A small fire erupted following the crash, Scott said. The airport houses L.A. County Fire Department equipment and personnel, who also witnessed the crash and were able to quickly extinguish the flames in the engine compartment and render aid, he added.

As soon as the plane took off, it appeared to have some sort of mechanical problem, the fire captain stated. Personnel from the FAA and National Transportation Safety Board were investigating the incident, Gregor said.

The plane was registered in Sheridan, Wyoming, according to FAA records. However, KTLA's Tim Lynn confirmed that the aircraft was based at Whiteman Airport.

PACOIMA, LOS ANGELES (KABC) -- A 60-year-old man died and a 12-year-old boy was critically injured after a small plane they were in crashed at Whiteman Airport in Pacoima.

Authorities said the single-engine Cessna 150L crashed near the 12600 block of West Osborne Street around 5:10 p.m. Monday shortly after takeoff.

The pilot radioed in an emergency just before the plane went down nose first, striking a building and then flipping upside down.

A Los Angeles County firefighting air facility is near the airport and firefighters were able to arrive on scene quickly. They put out a small fire that had started in the plane and extricated the two occupants.

Two people, a 12-year-old boy and 60-year-old man, were extracted from the debris.

They were taken to Holy Cross Medical Center.

The 60-year-old was in cardiac arrest after the crash and firefighters performed CPR before he was transported to the hospital.

He was initially described as being in grave condition. Later Monday night, Fire Department officials confirmed the man had died.

The 12-year-old was transported in critical condition.

It was unclear what caused the crash. However, the overwhelming majority of the crashes occur during takeoff or landing and are attributed mostly to pilot error.

The Federal Aviation Administration and National Transportation Safety Board will investigate.
