The father of 35-year-old Richard Lessert who was killed by a BNSF train while clearing snow and ice from the tracks in South Dakota files suit




RAPID CITY, S.D. (KOTA TV) - The family of one of two Burlington Northern Santa Fe railway employees killed in an accident near Edgemont in January is suing the company.
 
The father of 35-year-old Richard Lessert claims in the lawsuit that BNSF failed to protect him from being hit by a train.

The lawsuit says Lessert was killed while clearing snow and ice from a track. The lawsuit blames the company for not providing safe work environment and the tools necessary for the job.

The other man killed was 58-year-old Douglas Schmitz. A federal investigation into what happened is continuing.
