EPA RULEMAKING ON THE DEFINITION OF SOLID
WASTE: The EPA has finalized the
Definition of Solid Waste (DSW) rule.
Hazardous waste alert
The rule, which modifies the 2008 rule, requires offsite
recycling at a facility with a RCRA permit or verified recycler variance,
affirms the legitimacy of the pre-2008 DSW exclusions, revises a definition of
legitimate recycling, and includes a targeted manufacturing exclusion for
certain higher value hazardous spent solvents.
The EPA has released a pre-publication version of the final
rule.

Rulemaking on the Definition of Solid Waste AGENCY:
Environmental Protection Agency (EPA). ACTION:
Final rule.
SUMMARY: The
Environmental Protection Agency (EPA, or the Agency) is publishing a final rule that revises several recycling-related provisions associated with the definition of solid waste
used to determine hazardous waste regulation under Subtitle
C of the Resource Conservation and Recovery Act (RCRA). The purpose of these revisions
is to ensure that the hazardous secondary materials recycling regulations, as implemented, encourage
reclamation in a way that does not result in increased
risk to human health
and the environment from discarded hazardous secondary material.
DATES: This
final rule is effective on [Insert date 180 days after date of publication
in the Federal Register].
